Terms of Service

The short version#

These are the rules for using Caliber. By using it, you agree to them.

If you are a candidate, the important parts are: your account is with Caliber and you keep it after an interview ends; your interviews are recorded, transcribed, and scored automatically; your score and quoted excerpts of what you said go to the company you interviewed for; and we keep your results afterwards so we can match you to other roles, including at companies you have never applied to. You can ask a person to review a score you think is wrong. Caliber is free for you.

If you are a sales rep or manager, your employer bought Caliber and decides what is measured and who sees it. We act on their instructions.

This page explains all of it: what you can and cannot do here, what we promise, what we do not, and what happens if something goes wrong. Our Privacy Policy covers what we do with your data.

Who we are#

Caliber is operated by Caliber ASI Inc., a Delaware corporation, at 1209 Mountain Road PL NE, Ste R, Albuquerque, NM 87110, United States.

These terms are an agreement between you and Caliber ASI Inc. Where they say "we" or "us", that is who they mean. Where they say "you", that is the person using Caliber.

1 · What Caliber is, and who these terms are for#

Companies post sales roles on Caliber. You interview through an automated system that speaks with you and scores how you did. Caliber uses those results to help companies find people, and to help you find roles.

Three different kinds of people use Caliber, and their relationship with us is not the same. Find yourself below, because it changes which parts of these terms apply to you.

If you are a candidate. You found a role through a Caliber link and you interviewed for it. Your account is with Caliber, not with the company you interviewed for. We decide how your data is used, which makes us responsible for it. These terms are the agreement between you and Caliber, and all of them apply to you.

If you are a sales representative or a manager. Your employer bought Caliber and gave you access. They decided to use it, they decide what is measured, and they decide who inside your company sees the results. We act on their instructions. These terms still govern your use of the software, but section 6 explains what your employer controls rather than what we do. If you want your data corrected or deleted, start with your employer.

If you appeared in someone else's recorded sales call. You have no account with Caliber and no agreement with us. These terms do not apply to you, and nothing here asks anything of you. A Caliber customer recorded a call you were on, and that recording may be analysed in their Caliber account. That customer is responsible for it. If you want that data removed, contact the company whose representative you spoke to. You can also email us at privacy@caliberhq.com and we will pass the request on. The Privacy Policy explains this in more detail.

2 · Your account#

Your account is with Caliber. It is not an account with any company you interview for, and you keep it when an interview ends, whatever the outcome.

To use Caliber you must be at least 18 years old. Caliber is for people in professional employment and is not intended for anyone younger.

The information you give us has to be accurate. That includes your name, your contact details, your work history, and your résumé. Interviews are scored partly on what you claim about your own experience, so inventing it does not just breach these terms, it produces a result that does not help you.

One account per person. Do not share your login, do not let someone else interview in your place, and do not create an account for anyone but yourself. Keep your password to yourself and tell us at privacy@caliberhq.com if you think someone else has it.

If you are a rep or a manager, your employer created or invited your account and can remove your access to it.

3 · The AI interview, recording, and automated scoring#

This is the part of Caliber most worth reading carefully.

Your interview is recorded and transcribed, and an automated system scores it. An AI interviewer speaks with you. Your voice goes from your browser to our voice partner, which conducts the conversation and produces a written transcript. A large language model then scores the transcript against a rubric the hiring company defined. The Privacy Policy names every provider involved and what each one receives.

What we keep, today. We keep the transcript. We do not keep a copy of the audio ourselves, and our voice partner holds the recording only for a short period so we can retrieve the transcript if something goes wrong. We do not record video of your interview: if your camera shows a preview of you, that image stays on your own device.

That is how Caliber works now, not a promise about forever. We expect to start keeping interview audio, and possibly video, as the product grows. Before that applies to you we will update this section and the Privacy Policy, say plainly what we keep and for how long, and give you notice under section 15. Until we do, the paragraph above is what is actually happening.

One thing will not change without asking you separately. Keeping a recording is not the same as building a voiceprint, a voice clone, or any other biometric copy of you from it. We will not do that unless we ask you for permission specifically for it, tell you in writing what it is for and how long we would keep it, and let you refuse without losing your interview or affecting your result.

Your scores go to the hiring company, along with quoted excerpts of what you said. They see your overall score, the breakdown by criterion, your strengths and areas to improve, your speaking metrics, and direct quotes from your interview. That is the point of the service. By using Caliber you agree to that sharing.

What the automated score actually does

We want to be precise here, because "an AI decides" is both the common assumption and not what happens.

  • For each role, the hiring company sets a minimum Caliber score.
  • You take one introductory call and three scored practice calls. Your Caliber score is the average of your best result on each of the three scored calls. The introductory call is not scored toward it.
  • If your Caliber score meets or beats the company's minimum, your application advances.
  • If it does not, nothing marks you as rejected. It means the automated part of the process does not move you forward on its own. The hiring company can still look at your application and decide.
  • We show you your score and the company's minimum, so you know exactly where you landed.
  • You can re-attempt any of the scored calls, and we count your best result on each one. We do not currently limit how many times you try.

What clearing the bar changes on the company's side

We would rather tell you this than have you discover it. Inside the hiring company's view of their candidates, the button a manager uses to move you forward is switched off while your score is below their minimum. A person at that company can still see your profile, your results, and your excerpts, and can still contact you. But the automated score does constrain what the software lets them do in one click, and that is a real effect on you, not a cosmetic one.

You can ask a person to look

If you think an automated score got you wrong, email privacy@caliberhq.com and tell us why. A person at Caliber will review it and tell you the outcome.

We handle these by hand rather than through an automated tool. We will acknowledge your request within 7 days and give you an outcome within 30 days. If your case is complicated we may need up to a further 60 days, and we will tell you why within the first 30.

4 · What Caliber does with what you produce#

We keep your profile, your interview transcripts, and your results after an interview ends, and we use them to match you to other companies' roles. That is not a side effect of the service, it is part of what the service is. Read this section before you agree to it.

Specifically:

  • We keep your account, your profile, your résumé, your transcripts, and your results while your account is open. Your results do not expire when an application closes.
  • We use them to match you to other roles on Caliber, including roles at companies you have never applied to and have never heard of.
  • We share your results with the company whose role you interviewed for, as described above.
  • We do not sell your data. We do not share it with advertisers and we do not use advertising or analytics trackers.

Once a hiring company has your results, they hold their own copy and their own privacy policy governs it. If you later ask us to delete your data, we cannot reach their copy. We will tell you who they are so you can ask them directly.

If you would rather we stopped using your data to match you to new roles, or you want your account and everything attached to it deleted, email privacy@caliberhq.com. We handle these requests manually, on the same timescales as above: acknowledged within 7 days, completed within 30 days, extendable by up to a further 60 days for complicated requests if we tell you why within the first 30. The Privacy Policy sets out the full list of what you can ask us to do.

5 · Your privacy#

Our Privacy Policy is the full account of what we collect, why, who else sees it, how long we keep it, where it goes, and what you can ask us to do about it. It is part of these terms, and it is the document that governs if the two ever appear to disagree.

The short version of it is above and in the sections you have just read. If you want the detail, particularly the list of every provider that touches your interview, read the Privacy Policy rather than relying on the summaries here.

6 · Reps and managers: what your employer controls#

This section is for sales representatives and managers whose employer gave them Caliber. If you are a candidate, it does not apply to you.

Your employer decided to use Caliber, connected your calls, and decides who inside your company sees the results. We act on their instructions, not on our own.

Through Caliber, your employer can:

  • Connect your real sales calls from their call recording tool, so that the recordings and transcripts come into Caliber.
  • Have those calls scored automatically, and coaching feedback generated from them, including verbatim quotes of what you said.
  • See speaking metrics from your calls: pace, talk ratio, filler words per minute, and your longest uninterrupted stretch.
  • See a daily ranking of you against your colleagues in your organisation.
  • Assign you practice drills built from specific moments in your real calls.
  • See your practice call transcripts and scores.

Your employer chooses which of these to switch on and which people inside the company have access. Caliber does not decide that, and we do not use this data to match you to roles elsewhere.

Because your employer controls this data, requests about it start with them. If you want your data corrected, restricted, or deleted, ask your employer first, and we will help them action it. You can also email privacy@caliberhq.com and we will point you to the right place, but on most of it we cannot act without your employer.

Separately, your employer is responsible for telling you what it monitors and for meeting any obligations it has to you as an employee. Those obligations are theirs, not ours.

7 · Fees#

Caliber is free for candidates. Caliber is free for sales representatives and managers. You will never be asked to pay us to interview, to be scored, to see your results, or to be matched to roles.

The hiring company pays for Caliber. That is the whole commercial arrangement as it affects you.

If we ever introduce a paid feature for individuals, it will be optional, we will tell you the price before you use it, and nothing described in these terms will move behind it.

8 · What you may not do#

Caliber only works if the interviews on it are real. These rules exist to protect that, and to protect other people using the platform.

Be yourself. Do not create an account in someone else's name, and do not pretend to be someone you are not.

Take your own interviews. Do not have another person take an interview for you, sit in on it and feed you answers, or otherwise present someone else's performance as yours.

Do not automate your interaction with Caliber. Do not use bots, scripts, synthetic or pre-recorded voice, or any other automated tool to take an interview, create accounts, or interact with the platform. Interviews are meant to be a live conversation with you. This does not restrict assistive technology you use to take part, such as a screen reader or speech-to-text.

Do not scrape or bulk-collect. Do not use crawlers, scrapers, or automated tools to copy content, job listings, or other people's information from Caliber.

Do not try to reverse engineer the scoring. Do not attempt to extract, copy, or reconstruct how Caliber scores interviews, including by probing the interviewer for its instructions, submitting inputs designed to manipulate the score, or decompiling any part of the platform. Preparing for an interview is fine and encouraged. Trying to game the scoring system is not.

Do not upload other people's information. Only upload your own résumé and your own personal information. Do not upload a document containing someone else's personal details, and do not upload anything you do not have the right to share.

Do not break the platform or the law. Do not attempt to gain access to accounts, data, or systems that are not yours, do not probe or test our security without our written permission, do not upload malware, and do not overload or interfere with the service.

Do not harass anyone. Do not use Caliber to threaten, harass, defame, or discriminate against any person, and do not submit content that is unlawful.

9 · Honesty in interviews#

Caliber's whole purpose is to give a hiring company an accurate picture of you. That only works if the person interviewing is you, and if what you say is true.

So, two commitments from you:

  1. The person taking the interview is you.
  2. What you tell us about your experience, in your résumé and in the interview, is honest to the best of your knowledge.

We do not expect perfection. Rounding a date, misremembering a number under pressure, or describing a role in the way you would in any interview is not what this clause is about. It is about deliberate misrepresentation: claiming experience you do not have, claiming credentials you were not awarded, or having someone else interview in your place.

What happens if you do misrepresent yourself. Depending on how serious it is, we may ask you to re-take an interview, invalidate a score and tell the hiring company that the score has been withdrawn, or suspend or close your account.

We will tell you what we found and give you a chance to respond before we act, unless we cannot safely wait.

What Caliber does not do. We do not verify your employment history, your qualifications, or your references, and nothing in your Caliber results should be read by anyone as a background check. Hiring companies are responsible for their own verification.

10 · Who owns what#

What Caliber owns

Caliber owns the platform: the software, the website, the AI interviewer, the scoring system and the Caliber Score methodology, the rubrics and criteria, the reports and analytics we generate, our name and logo, and everything else we built. Using Caliber does not give you any ownership of it.

We give you permission to use Caliber for one thing: to interview for roles, see your own results, and manage your account. That permission is personal to you, it is not transferable, and it lasts as long as your account does.

What you own

You own what you submit. Your résumé is yours. Your professional history is yours. What you say in an interview is yours. Nothing in these terms transfers ownership of any of that to Caliber, and we do not claim it.

What we need permission to do with it. To run the service you asked for, we need your permission to do the ordinary things that make it work. You give Caliber permission to store, copy, transcribe, analyse, score, and display your submitted content, and to share your profile, your results, and quoted excerpts from your interview with hiring companies, in order to:

  • conduct and score your interviews,
  • show you your own results and feedback,
  • share your results with a company whose role you interviewed for,
  • match you to other roles on the platform, as described in the Privacy Policy, and
  • improve Caliber, including how interviews are scored, as described in the Privacy Policy. You can object to this one without affecting your account.

That permission is limited to running Caliber for you. It is not exclusive, so you can use your own résumé and your own history anywhere else you like, and it ends when you delete your account, except for copies we are required to keep by law and copies already held by a hiring company. We cannot pull back a copy someone else already has.

What we will not do with it. We will not sell your content. We will not use your voice or your likeness in marketing. We will not publish your interview or your results anywhere other than to a hiring company as described above and in the Privacy Policy.

Feedback

If you send us a suggestion about how Caliber could be better, we may use it without owing you anything for it. This covers product feedback only, not your interview content.

11 · What we promise, and what we do not#

We work hard to make Caliber useful and to keep it running. But we have to be straight with you about the limits of what it is.

Caliber is provided as it is. CALIBER IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DO NOT WARRANT THAT IT WILL ALWAYS BE AVAILABLE, ERROR FREE, OR UNINTERRUPTED, THAT IT WILL WORK WITH EVERY DEVICE OR BROWSER, OR THAT TRANSCRIPTION WILL BE ACCURATE. TO THE FULLEST EXTENT PERMITTED BY LAW, CALIBER DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee you a job. This is the most important sentence in these terms. Using Caliber does not guarantee you employment, an interview with a human, a callback, or any hiring outcome at all. Caliber is not an employer, not a recruiter acting for you, and not your agent.

We do not control hiring decisions. Companies using Caliber decide for themselves who to hire, who to advance, and what score they will accept. Those decisions are theirs, made on their criteria, and often on information that has nothing to do with Caliber. We do not make them and we cannot overturn them.

Scores are an assessment, not a verdict on you. Your Caliber score is an automated assessment of one conversation, against criteria one company chose. It is a useful signal. It is not a measurement of your ability, your potential, or your worth as a candidate, and it can be wrong. Automated scoring can miss context, misread an accent or a connection problem, and does not know what you did not get a chance to say. That is exactly why you can see your score, re-attempt scored calls, and ask a person at Caliber to review a result, as described in section 3.

We do not vet the companies. We do not guarantee that a role posted through Caliber is genuine, still open, or accurately described, and we are not responsible for how a company treats you. If something about a role looks wrong, tell us at privacy@caliberhq.com.

Where the law gives you rights we cannot take away, we do not try to. Some places give consumers guarantees that cannot be excluded. Nothing here limits those.

12 · Limits on what we owe you#

Caliber is free for candidates, and these limits reflect that. They are also subject to the law where you live, and some places do not allow limits like these. Where that is the case, they do not apply to you.

What we are not liable for. TO THE FULLEST EXTENT PERMITTED BY LAW, CALIBER IS NOT LIABLE FOR:

  • ANY JOB YOU DID NOT GET, ANY OFFER THAT WAS WITHDRAWN, OR ANY HIRING DECISION MADE BY A COMPANY;
  • LOST INCOME, LOST EARNINGS, LOST OPPORTUNITIES, LOST PROFITS, OR LOSS OF REPUTATION;
  • INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL LOSSES, MEANING KNOCK-ON EFFECTS RATHER THAN DIRECT ONES; OR
  • ANYTHING CAUSED BY A HIRING COMPANY, ANOTHER USER, OR A SERVICE OUTSIDE OUR CONTROL.

The cap. IF WE ARE LIABLE TO YOU FOR SOMETHING DESPITE THE ABOVE, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS IS LIMITED TO THE GREATER OF WHAT YOU PAID CALIBER IN THE TWELVE MONTHS BEFORE THE CLAIM, OR ONE HUNDRED US DOLLARS (USD 100).

What we never try to limit. Nothing in these terms limits our liability for fraud or fraudulent misrepresentation, for death or personal injury caused by our negligence, for anything else the law does not permit us to limit, or for rights you have under consumer or data protection law that cannot be signed away.

13 · If you cause us a problem#

This section is deliberately narrow. You are using a free service to apply for jobs, and it would not be fair to make you underwrite our business.

IF YOU DO ONE OF THE FOLLOWING, AND IT CAUSES A THIRD PARTY TO BRING A CLAIM AGAINST US, YOU AGREE TO INDEMNIFY US FOR AND COVER THE REASONABLE COSTS AND DAMAGES WE ACTUALLY INCUR AS A DIRECT RESULT:

  • YOU UPLOADED CONTENT YOU DID NOT HAVE THE RIGHT TO UPLOAD, OR THAT INFRINGES SOMEONE ELSE'S RIGHTS;
  • YOU UPLOADED ANOTHER PERSON'S PERSONAL INFORMATION WITHOUT THEIR PERMISSION; OR
  • YOU DELIBERATELY MISREPRESENTED YOUR IDENTITY, AND A HIRING COMPANY SUFFERED LOSS BECAUSE OF IT.

That is the whole list. You are not responsible for claims arising from our own acts, our own systems, our scoring, or our handling of your data, and you are not responsible for anything you did in good faith.

If a claim like this comes up, we will tell you promptly, we will let you take part in the defence, and we will not settle it in a way that puts an obligation on you without asking you first.

14 · Ending your account, and when we can end it#

You can leave whenever you want

You can stop using Caliber at any time. To close your account and have your data deleted, email privacy@caliberhq.com and ask. We do not require a reason.

Leaving does not affect any application already in progress with a hiring company. They keep the copy of your results they already have, and their own privacy policy governs it.

When we may suspend or close your account

We may suspend or close your account if:

  • you break the rules in section 8 or the honesty commitments in section 9,
  • we reasonably believe someone else is using your account, or that your account is being used to interview on someone else's behalf,
  • we are required to by law, or
  • we stop offering Caliber, or stop offering it in your country.

Before we act, we will tell you why and give you a chance to respond, unless the situation is urgent (an active security problem, a legal requirement, or a risk of harm to someone). If we have to act first, we will tell you as soon as we reasonably can.

Suspension is usually temporary. If we suspend you, we will tell you what would resolve it. If you think we got it wrong, reply and a person will look at it.

What happens to your data

If you close your account, or we close it, your data is handled as described in the Privacy Policy, which sets out what we delete, how long it takes, and the narrow cases where we have to keep something. We do not restate those terms here so that there is only one place they can change.

What survives

If your account ends, these terms stop applying to your use of Caliber, except for the parts that by their nature have to outlive it: ownership, disclaimers, limits on what we owe you, section 13, and section 16.

15 · Changes to these terms#

We will post a new version here with a new version number and effective date.

If a change materially affects your rights or what we do with your interviews, we will ask you to accept the new version before you keep using Caliber, and we will tell you in plain language what changed. Smaller changes (a corrected address, a clearer sentence) take effect when we post them.

We will not apply a material change to you retroactively.

We keep a record of which version you accepted and when. Previous versions stay available on this page.

If you do not want to accept a new version, you can stop using Caliber and email privacy@caliberhq.com to have your account and data deleted.

16 · If we disagree#

Talk to us first

If something goes wrong, email privacy@caliberhq.com and tell us what happened. Most things get sorted this way, and it is faster than anything else on this page. We will respond within 30 days.

Governing law

THESE TERMS ARE GOVERNED BY THE LAWS OF THE STATE OF DELAWARE, WITHOUT REGARD TO ITS CONFLICT OF LAWS RULES.

If you live somewhere whose consumer protection laws give you rights you cannot contract out of, this does not take those away, and you can still rely on them.

Where disputes are heard

ANY DISPUTE THAT WE CANNOT RESOLVE BETWEEN US WILL BE HANDLED EXCLUSIVELY IN THE STATE OR FEDERAL COURTS LOCATED IN DELAWARE, AND YOU AND CALIBER CONSENT TO THE PERSONAL JURISDICTION OF, AND VENUE IN, THOSE COURTS. If you live outside the United States, this does not stop you from bringing a claim in your local courts where the law gives you that right.

17 · The rest#

If one part does not hold up, the rest still does. If a court decides some part of these terms cannot be enforced, that part is removed or narrowed to the smallest extent needed, and everything else stays in force.

Not enforcing something once does not mean giving it up. If we do not act on a breach straight away, we can still act on it later, and on any other breach.

Transferring these terms. You cannot transfer your account or your rights under these terms to anyone else. We may transfer ours to a company that acquires Caliber or the relevant part of our business, and if we do we will tell you, and the new owner is bound by these terms and by the Privacy Policy as they stand at that time.

These terms, plus the Privacy Policy, are the whole agreement. Together they are the complete agreement between you and Caliber about your use of the service, and they replace anything said before. If something in these terms conflicts with the Privacy Policy about how we handle your personal data, the Privacy Policy wins.

We are not partners. Nothing here makes you and Caliber employer and employee, partners, or agents of each other. You are not Caliber's employee, and Caliber is not your recruiter or agent.

Nobody else can enforce these terms. These terms are between you and Caliber. No other person or company has rights under them.

Things outside our control. WE ARE NOT RESPONSIBLE FOR FAILING TO DO SOMETHING UNDER THESE TERMS IF THE CAUSE IS GENUINELY OUTSIDE OUR CONTROL, SUCH AS AN OUTAGE AT A PROVIDER WE DEPEND ON, A NATURAL DISASTER, OR A CHANGE IN THE LAW.
